RULES
1. The "Win A Moissanite" drawings are sponsored by Moissanite Fine
Jewelry, 5235 West 26th Street
Sioux Falls, SD 57103 USA
2. The "Win A Moissanite" drawings are open to legal residents
of the United States who make a purchase from Moissanite Fine Jewelry,
and are 18 years of age or older at time of entry. The "Win A Moissanite"
drawings are not open to: (a) Moissanite Fine Jewelry employees, agents,
consultants, officers or members of the board of directors; (b) employees
or agents of any organization directly involved with the drawings;
or (c) their immediate family members of or persons residing in the
same household as those persons identified in (a) and (b) above. Each
winner is subject to proof of eligibility. VOID WHERE PROHIBITED OR
RESTRICTED BY LAW.
3. The Moissanite Fine Jewelry "Win A Moissanite" drawings
will be held on an ongoing basis, and the winners of these drawings
will be notified via email.
4. To enter: Participants may enter the Moissanite Fine Jewelry "Win
A Moissanite" by filling out the online billing and shipping form located
in the check out process of the Moissanite Fine Jewelry website. Entries
are limited to a total of one (1) on-line entry per household (determined
by street address). Moissanite Fine Jewelry
will reject any subsequent entries from the same household. Automated
drawing entries, meaning entries that are software generated and
do not require the entrant to visit the Moissanite Fine Jewelry website,
are prohibited. Moissanite Fine Jewelry will reject any entries submitted
by automatic entry. Participants must complete all required data requested.
A valid email address is required for entry. Incomplete or inaccurate
entry forms are void. Moissanite Fine Jewelry is not responsible
for entries that are corrupted or otherwise not received correctly
or for any problems or technical malfunction of any telephone network
or lines, computer on-line systems, servers or providers, computer
equipment, software, failure of email, or on account of technical problems
or traffic congestion on the Internet or at any Web site or combination
thereof, including injury or damage to participants or to any other
person's computer related to or resulting from participating or downloading
materials in these drawings. Moissanite Fine Jewelry is not responsible
for lost, late or misdirected entries. If, for any reason, the drawings
are not capable of running as planned, including infection by computer
virus, bugs, tampering, unauthorized intervention, fraud, technical
failures, or any other causes beyond the control of Moissanite Fine
Jewelry which corrupt or affect the administration, security, fairness,
integrity or proper conduct of these drawings, Moissanite Fine Jewelry reserves
the right at its sole discretion to cancel, terminate, modify or suspend
the drawings. Entries that have been tampered with or altered are void.
All entries shall become the sole property of Moissanite Fine Jewelry
and will not be acknowledged or returned.
5. By entering, participants acknowledge compliance with these Official
Rules, including all eligibility requirements. Entry into these drawings
authorizes Moissanite Fine Jewelry to add participant information into
the Moissanite Fine Jewelry mail list database. Moissanite Fine Jewelry
will use this mail list database to occasionally send interesting information,
news or special offers relating to Moissanite fine jewelry created
by Charles & Colvard.
Participants may request removal from this mail list upon receiving
the first electronic mailing from Moissanite Fine Jewelry (instructions
for removal are included with each mailing). Moissanite Fine Jewelry
respects your privacy. We do not give or sell your information to other
companies or individuals without your permission. We take reasonable
security precautions to protect your information from unauthorized
access.
6. Moissanite Fine Jewelry will award the prize(s) for each drawing.
7. The odds of winning will be determined by the total number of eligible
entries received.
8. By participating in the Moissanite Fine Jewelry "Win a Moissanite"
drawings, entrants agree to be bound by these rules and by the decisions
of Moissanite Fine Jewelry
which are final in all matters relating to this drawings.
9. Potential winners will be notified by email or telephone on or
about the Monday after the random drawing for each drawing period.
Upon notification, all potential winners must respond by email or telephone
to confirm identity and eligibility. If there is no response from the
potential winner within four weeks from the end of the drawings
period, or the potential winner fails to return a signed and notarized
affidavit and release provided by Moissanite Fine Jewelry to Moissanite
Fine Jewelry in a timely manner, an alternate winner will be selected
at random from among remaining eligible entries. Moissanite Fine Jewelry
will post the winners names after the prize has been accepted by the
winner.
10. All prizes are non-transferable. No cash will be awarded. Arrangements
for the fulfillment of prizes will be made by Moissanite Fine Jewelry.
Where permitted by law, Moissanite Fine Jewelry reserves the right
at its sole discretion to substitute any and all prizes with prizes
of comparable value. Prize winners may be required to sign (i) an affidavit
of eligibility and release of Moissanite Fine Jewelry, its employees
and agents from any and all liability, claims, demands, and causes
of action for personal injury and/or damage, theft, or loss suffered
in connection with this promotion or the use or acceptance of the prize
or any portion thereof to be eligible for the prizes; and (ii) where
permitted, a promotional release granting the right to use his or her
name and likeness for advertising and publicity purposes without additional
compensation. Entry into the "Win A Moissanite" drawings constitutes
the winner's agreement to sign such release. Prize winners must also
complete all legal documents and return them to Moissanite Fine Jewelry
within three (3) working days after receipt of any such documents.
Noncompliance will result in disqualification and an alternate winner
will be selected from among remaining eligible entries.
11. The value of the prizes may be taxable as income. Upon receipt
of any prize, winners are required to comply with any and all applicable
federal, state and local tax laws and pay all such taxes as becomes
due with respect to the prize(s). Winners agree to indemnify and hold
harmless Moissanite Fine Jewelry, its employees and agents from and
against any liability for such taxes.
12. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (IN MOISSANITE
FINE JEWELRY"S SOLE DETERMINATION) WILL RESULT IN SUCH WINNER'S DISQUALIFICATION
AS WINNER OF THE SWEEPSTAKES AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY
TERMINATED. The receipt by the winners of the prize components of these
drawings are conditioned upon compliance with these rules and with
any and all federal, state and local rules and regulations.
13. Moissanite Fine Jewelry reserves the right at its sole discretion
to disqualify any individual it finds to be tampering with the entry
process or the operation of the drawings or web site; to be acting
in violation of the Official Rules; or to be acting in an unsportsmanlike
or disruptive manner, or with intent to annoy, abuse, threaten or harass
any other person.
14. The winners agree that Moissanite Fine Jewelry, its employees,
and agents shall have no liability in connection with acceptance or
use of any of the prizes awarded herein.
15. The winners agree that these drawings are governed by the laws
of the State of South Dakota, without regard to conflicts-of-laws
or choice-of-law rules of such state and that all claims relating to
the drawings must be brought in the state or federal courts located
in Minnehaha County, Sioux Falls, Sd, which shall have exclusive jurisdiction
and venue over such claims.
