TERMS & CONDITIONS
The Terms and Conditions contained herein ("The Agreement") shall be binding on each and every
customer ("Customer" or "Seller" or "You") of Trillion-LLC, dba MoissaniteFineJewelry.com. These Terms
& Conditions are subject to change without notice. Current Terms and Conditions are available by going
to www.moissanitefinejewelry.com and clicking on Moissanite Trade-Up Program and then Trade Up
Your Old Gold Terms & Conditions. Any such changes will be immediately posted and apply as soon as
they are posted. Any changes in the terms and conditions will not apply to transactions in which a
registration number was obtained prior to the effective date of such changes.
For the purpose of this Agreement, MoissaniteFineJewelry.com and Trillion-LLC shall be referred to
collectively as "MFJ," "We" or "Us." What we purchase shall be referred to as "jewelry," "precious
metals," "gold," "content," "goods," "items," "material" or "shipment."
MFJ accepts your gold jewelry and other gold items for refining only, not for resale. The credit value We
allow to each Seller is based upon the total weight and purity or karat grade (pure precious metal
content) contained in the material purchased, factored with the precious-metal market value according
to the current London Fix (the price at which gold is set during two daily bidding sessions in London) -
not on the material's potential value if resold intact. For this reason, we cannot pay for pearls,
gemstones, or other non-precious metal material in the jewelry. We may, at our sole discretion, return
your merchandise if we determine the value of the stones outweighs the value of the gold. We do not
accept items which are new or appear to be new (i.e. contain price tickets or other manufacturing tags
or tickets. We also do not accept Investment metals (gold coins, bars, bullion, ingots) or timepieces (i.e.
watches, pocket watches). To ensure you get the best possible credit for these items, we recommend
you visit another reputable source.
We will credit as much gold as you wish to send in a single shipment, not to exceed a maximum of
$2,500 in credit value and not to exceed $7,500 in credit value during a 12-month period. We will accept
a maximum of four packages from any single address over a 12-month period. Maximum credit values
and maximum shipping packages are inclusive of your participation in other gold exchange programs
operated by MFJ over a 12 month period.

or by telephone at 1-888-345-8725. However, e-mails will be the primary form of communication
between MFJ and the Customer. E-mails sent from MFJ to the Customer will be conclusive and binding.
How Your Gold is Exchanged for Credit Toward A Purchase:
1. Obtain a registration number from MFJ by requesting Your Refining Form from 1-888-345-8725 or
moissanitefinejewelry.com. Material will not be accepted for purchase without a valid registration
number.
2. Follow the instructions supplied in the form for sending your gold or precious metal items to MFJ.
3. When MFJ receives your package, you will receive an email.
4. Your gold is unpacked, weighed, and tested to determine the content of your gold.
5. The credit value we offer is based on the current London Fix (the price at which gold is set during two
daily bidding sessions in London). As soon as a value for your gold is determined, you will receive an
email with the amount. If this offer is acceptable to you, reply to the e-mail that you accept the offer. If
you dispute the amount offered by MFJ or want to cancel your transaction you must do so at this point
and your items will be returned to you. Once you accept the offer the refining process will be started
and cannot be stopped.
Requirements for Participation
You must be at least twenty-one (21) years of age in order to send jewelry or other precious metal items
to MFJ. In addition, you must be the actual legal owner of any and all precious metals, jewelry, or other
property sent, or attempted to be sent, to MFJ, and you must have the authority to send that
merchandise and must be acting on your own behalf and not as an agent or representative of any other
person or any company. We may request documentation of proof of age or ownership. By shipping your
goods to MFJ, You are representing that you are the legal owner of and have the authority to send the
merchandise shipped and you accept all terms and conditions set forth herein and those described on
our website, which are subject to change.
Guaranty Against Loss
MFJ will guaranty against loss of the total contents and liability limitations set forth when properly
shipped to MFJ, in accordance with the instructions and procedures established by MFJ, and subject to
the Terms and Conditions herein. We reserve the right to reject delivery of any mail, envelope or
package which appears to be damaged, opened, or tampered-with, and any such mail, envelope or
package will be returned by the postal service or courier service to the Customer. MFJ shall have no
liability to any Customer for any such attempted delivery or return of any such items.
Limitation of Liability
This limitation of liability shall be binding on each and every Customer and on any third party, including,
but not limited to, the Customer and the Customer's successors, assigns, insurance carriers and any
other individual or entity asserting any right or claim relating to Customer's transaction with MFJ. No
Liability for Property in MFJ’s Possession: In no event shall MFJ be liable for any damages from the loss
or destruction of property in its possession for any reason - including negligence - except as stated in
this Agreement. In no event shall MFJ be liable to any third party, including any insurance carrier, nor
shall MFJ be liable for any subrogation claim brought by the Customer's insurance carrier. By submitting
an item to MFJ, the Customer expressly and specifically waives any such subrogation claim on his or her
behalf, as well as on the behalf of his or her insurance carrier.
No Other Liability: MFJ shall not be liable to anyone for any damages, including, but not limited to,
incidental, consequential, punitive, loss of profit or opportunity - other than as set forth herein above.
By submitting your items, you explicitly and expressly accept this limitation of liability.
Return Insurance Liabilities
Any merchandise returned to You will be insured for the appraised value. You must agree to pay for the
cost of any return shipping charges and the cost of the insurance. MFJ shall, in its sole discretion,
choose the return carrier, insurance amount and receipt-verification method for each transaction.
Choice of Law, Waiver, Claims, and Arbitration
The Agreement shall be governed by the laws of the State of South Dakota, without regard to its conflict
of law provisions. MFJ's failure to exercise or enforce any right or provision of the Agreement will not be
deemed to be a waiver of such right or provision. If any provision of the Agreement is found by a court
of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to
give effect to the parties' intentions as reflected in the provision, and the other provisions of the
Agreement remain in full force and effect. You agree that, regardless of any statute or law to the
contrary, any claim or cause of action arising out of or related to use of the services offered by MFJ must
be filed within one (1) year after such claim or cause of action arose, or be forever barred. Subject to
any applicable law, any such claim or cause of action must be submitted to binding arbitration in the
State of South Dakota. Any and all disputes arising under The Agreement that cannot be resolved
between the parties shall be determined through binding arbitration to be conducted generally in
accordance with the Commercial Arbitration Rules of the American Arbitration Association.
Notwithstanding, claims within the monetary jurisdiction of South Dakota’s Municipal Courts, may be
pursued by either party, at the claimant’s option, in a court of competent jurisdiction in Minnehaha
County, South Dakota, or pursued in arbitration as set forth above. Each party consents to the venue
and jurisdiction of said courts. MFJ shall be entitled to reimbursement for any and all costs incurred by
it in defending any civil action filed, or attempted to be filed, in any jurisdiction outside of the State of
South Dakota, including but not limited to, attorney's fees incurred by MFJ.
